Welcome to NutraWag. These Terms of Use ("Terms") govern your access to and use of the NutraWag website located at nutrawag.ca (the "Site") and the purchase of our pet supplement products. By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SITE OR PURCHASING OUR PRODUCTS.

1. Acceptance of Terms

By accessing, browsing, or making a purchase on our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you must not use our Site or purchase our products.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

3. Eligibility

You must be at least 18 years of age to use our Site and purchase our products. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Products and Services

Product Information

NutraWag offers pet supplement products designed to support your pet's health and wellbeing. We make every effort to display our products accurately, including descriptions, images, pricing, and availability. However:

• Product images are for illustrative purposes and may not reflect the exact appearance of the product
• We do not warrant that product descriptions, pricing, or other content is accurate, complete, or error-free
• We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice

Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time. In the event a product is unavailable after you place an order, we will notify you and provide a refund or offer a suitable alternative.

Veterinary Advice Disclaimer

IMPORTANT: The information provided on our Site is for educational purposes only and is not intended to replace professional veterinary advice, diagnosis, or treatment. Our products are Veterinary Health Products notified with Health Canada. They support normal health and are not intended to diagnose, treat, cure, or prevent any disease in pets.

Always consult with a licensed veterinarian before:

• Starting your pet on any new supplement regimen
• Making changes to your pet's diet or health routine
• Using our products if your pet has existing health conditions or is taking medication
• Addressing any health concerns about your pet

Never disregard professional veterinary advice or delay seeking it because of information found on our Site.

5. Pricing and Payment

Pricing

All prices are listed in Canadian dollars (CAD) and are subject to change without notice. The price charged for a product will be the price displayed on the Site at the time your order is placed, subject to the terms below.

Prices do not include sales tax. Applicable GST/HST and provincial sales tax are calculated at checkout based on your shipping address.

Pricing Errors

Despite our best efforts, pricing errors may occur. If we discover a pricing error after you have placed an order, we will:

• Contact you to inform you of the error
• Give you the option to purchase the product at the correct price or cancel your order for a full refund

We reserve the right to cancel any order affected by a pricing error, even if the order has been confirmed.

Payment

We accept the following payment methods: credit cards, debit cards, and other approved payment methods. Payment processing is handled securely by our third-party payment processor. We do not store your complete credit card information on our servers.

By providing payment information, you represent and warrant that:

• You are legally authorized to use the payment method
• The payment information you provide is accurate and complete
• You will pay all charges incurred by you or anyone using your account

6. Orders and Order Acceptance

Placing an Order

When you place an order through our Site, you are making an offer to purchase products subject to these Terms. You will receive an email confirmation acknowledging receipt of your order. This confirmation does not constitute our acceptance of your order.

Order Acceptance

We reserve the right to accept or reject any order for any reason, including but not limited to:

• Product availability
• Errors in product or pricing information
• Suspected fraudulent or unauthorized transactions
• Credit or payment issues
• Inability to ship to your location

Your order is accepted when we ship the products to you and send you a shipping confirmation email.

Order Cancellation by You

You may cancel your order before it ships by contacting us immediately at sales@nutrawag.ca. Once an order has shipped, it cannot be cancelled, but you may return it in accordance with our Return Policy (Section 8).

Order Cancellation by Us

We reserve the right to cancel any order at any time before shipment for the reasons listed above. If we cancel your order, we will notify you by email and issue a full refund to your original payment method.

7. Shipping and Delivery

Shipping Within Canada

We currently ship only within Canada. We use reputable carriers including Canada Post and courier services. Shipping costs and estimated delivery times will be displayed at checkout and depend on:

• Your shipping address
• The size and weight of your order
• Your selected shipping method

Delivery Times

Estimated delivery times are provided in good faith but are not guaranteed. We are not responsible for delays caused by:

• Shipping carriers
• Weather conditions or natural disasters
• Customs inspections (if applicable)
• Incomplete or incorrect shipping addresses
• Recipient unavailability

Risk of Loss

Risk of loss and title for products pass to you upon delivery to the shipping carrier. You are responsible for filing any claims with the carrier for damaged or lost shipments after the package has been delivered to the carrier.

Shipping Address

You are responsible for providing accurate and complete shipping information. We are not responsible for delays or non-delivery due to incorrect addresses provided by you. If a package is returned to us due to an incorrect address, we will contact you to arrange re-shipment at your expense.

8. Returns, Refunds, and Satisfaction Guarantee

Our returns and refund policy, including our 60-day satisfaction guarantee, is set out on our Shipping & Returns page, which forms part of these Terms. In summary:

• You may request a full refund of the product price within 60 days of delivery by emailing sales@nutrawag.ca with your order number.
• In many cases you will not need to ship the product back.
• Shipping charges are non-refundable.

If this section and the Shipping & Returns page ever differ, the Shipping & Returns page applies.

Damaged or Defective Products

If you receive a damaged or defective product, please contact us immediately at sales@nutrawag.ca with:

• Your order number
• Photos of the damaged or defective product (if possible)
• A brief description of the issue

We will promptly send you a replacement product at no charge, or issue a full refund—whichever you prefer.

Our Commitment to You

We believe in our products and want you and your pet to love them. If for any reason you're not satisfied, we make it easy to get your money back. No complicated forms, no return shipping hassles, no questions asked. Your satisfaction is guaranteed.

9. User Accounts

Account Creation

You may create an account to access certain features, track orders, and manage subscriptions. When you create an account, you must provide accurate and complete information.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We are not liable for any loss or damage arising from your failure to protect your account credentials.

Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior toward our staff or other customers

10. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, software, and other materials (collectively, "Content"), is the property of NutraWag or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

• Copy, reproduce, modify, or create derivative works of our Content
• Distribute, sell, or exploit our Content for commercial purposes
• Remove or alter any copyright, trademark, or other proprietary notices
• Use our Content in any way that infringes our intellectual property rights

Trademarks

NutraWag, our logo, and other marks are trademarks of NutraWag. You may not use our trademarks without our prior written consent.

User-Generated Content

If you submit reviews, testimonials, photos, or other content to the Site ("User Content"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, publish, and display such User Content for marketing and promotional purposes.

You represent and warrant that:

• You own or have the necessary rights to the User Content you submit
• Your User Content does not violate any third-party rights or applicable laws
• Your User Content is accurate and not misleading

11. Prohibited Uses

You agree not to use the Site for any unlawful purpose or any purpose prohibited by these Terms. Prohibited uses include, but are not limited to:

• Violating any applicable federal, provincial, or local laws or regulations
• Infringing the intellectual property rights of others
• Transmitting harmful code, viruses, or malware
• Attempting to gain unauthorized access to our systems or networks
• Interfering with the proper functioning of the Site
• Engaging in any form of automated data collection (scraping, crawling, etc.) without our permission
• Impersonating another person or entity
• Harassing, threatening, or defaming others
• Submitting false or misleading information
• Using the Site to distribute spam or unsolicited commercial communications

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

NutraWag, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Site or products
• Any conduct or content of any third party on the Site
• Unauthorized access, use, or alteration of your content or data
• Any adverse reaction or health issue experienced by your pet from using our products

In no event shall our total liability to you for all claims arising out of or related to the use of the Site or products exceed the amount you paid us for the product in question, or $100 CAD, whichever is less.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless NutraWag and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of the Site or products
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your User Content

14. Disclaimers

No Warranties

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY.

We do not warrant that:

• The Site will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Site is free of viruses or other harmful components
• The results of using the Site or products will meet your expectations

Product Results

Individual results from using our products may vary. We do not guarantee specific results for your pet. Our products are Veterinary Health Products notified with Health Canada. They support normal health and are not intended to diagnose, treat, cure, or prevent any disease.

15. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Jurisdiction

You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the courts located in British Columbia, and you consent to the jurisdiction of such courts.

Dispute Resolution

Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally by sending a written notice to sales@nutrawag.ca describing the dispute and your proposed resolution.

We will attempt to resolve the dispute within 30 days. If we cannot resolve the dispute informally, either party may pursue legal remedies.

16. Compliance with Laws

We comply with all applicable Canadian federal and provincial laws, including:

• Personal Information Protection and Electronic Documents Act (PIPEDA)
• Competition Act
• Consumer Protection Acts
• Food and Drugs Act (as applicable to pet supplements)
• Canada's Anti-Spam Legislation (CASL)

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and NutraWag regarding your use of the Site and purchase of products.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

20. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.
